In the recent case of Re Janson; Gash v Ruzicka [2020] VSC 449 (23 July 2020), McMillan J held that before the court can be satisfied that a plaintiff has been left without adequate provision under a Will, the court needs to be satisfied that it has been provided with adequate evidence of the plaintiff’s financial resources. In the above case, Maya Rozner successfully argued that in the absence of such evidence a moral claim alone is not sufficient to warrant an order for further provision.
